Says Tony, "I was drawn to the flat fee consulting model
of real estate practice because I am uncomfortable with the conflict of
interest inherent in the traditional listing arrangement and the image of the
real estate agent as "salesperson" as opposed to
"professional."
"In the traditional contingency fee listing arrangement,
agents are not disinterested parties. They are attached to the outcome. They
want to get paid. The only way this happens is if there is a sale - even if it
is not in their client-seller's or client buyer's best interest."
"This tends to affect the mindset of the listing agent
from the very beginning. For the listing agent, obtaining the listing is
actually
more critical than the ultimate sale. In my view, this makes agents listing FSBOs
uncomfortably like lawyers chasing ambulances."
"Then again, the contingency fee model does not recognize
the fact that it really takes no more effort to sell a $600,000 home than a
$300,000 home. Yet the fee is doubled. In my opinion, while a "value
added" element based on the value of the property is legitimate, an enhanced fee is
mainly
justified to the extent of proportional risk exposure and Errors & Omissions
issues."
"Our philosophy also goes to how we treat buyers. We
offer significant rebates based on the buyer saving us time and effort by using
the search capabilities of the Multiple Listing Service, which is newly available on the
Internet, and then doing his or her own initial follow up and research on properties and
neighborhoods. We provide on our web site the Internet-based tools

the CPA's, where the client selects the level of service desired. The agent is
