
Important Do's and Don'ts for Buyers
Protect Your Commission Rebate
There is a rule in California real estate called
"Procuring Cause." This means that the Broker responsible for bringing
in the Buyer to a successfully concluded transaction is entitled to the
commission offered by the Seller to the "Selling Office." The Selling
Office is the Buyer's Broker.
So, in order to protect the rebate that you, the Buyer,
will be getting from
us, it is important that you do not give other brokers/agents any reason to
maintain that you have been working with them and that they are the "procuring
cause." If you do, you will lose out on your commission rebate.
So, here are some important Do's and Don'ts:
DO
1. Enter into a Buyer Broker Agreement with us, reflecting
our mutual commitment and your right to a rebate. The fact that you have
entered into such an agreement with us will protect you against the hard
selling agents who will try to fast talk you into letting them represent
you.
2. Tell every agent you come in contact with (such as at an
open house) that you are already working with a buyer's broker - us. Give them one of
our business cards.
3. If you come across a home that you like, call the
listing agent in person and ask to be shown the property. Explain that you
are working with us as your buyer's broker, but we are not available to show
the property right now.
4. With new home construction and new home communities that
cooperate with buyers' agents, it is ESSENTIAL that we register with the
builder that we are your representative. If you see a subdivision that interests you,
call us. We may be able to register you by phone or fax. Otherwise we will come
out and meet you at the subdivision. If you do not take this precaution, you will lose out on representation
during the sale, you won't get a rebate, and we won't get paid either!
DO NOT
1. Do not sign or say anything that would suggest
you are going through any other agent but us for your purchase. This also
means that you do not sign a guest book at an
open house.
2. Do not pretend to any agent or broker that you are
"just looking" for a friend or family member. Be direct. Tell them you
are working with us. It is ESSENTIAL that you do not give any other agent
a reason or excuse to claim that s/he is the "procuring cause."
3. Do not allow anyone but us to present offers on the home
you want.
4. Do not use the time and
services of another agent to show you properties and then come to us to make
an offer and prevent the other agent from being paid a commission. If you
use that agent's time and effort, that agent deserves to be paid. This is
the same as you deserving to be paid a rebate for putting your time and effort into
the property search, when we represent you.
OPEN HOUSES
When you go into open houses, tell the
agents holding them open that you are working with us. Give them one of our
cards. Show them a copy of your Buyer Broker Agreement with us. Search
