Disclosure Law in California
The “Natural Hazard Disclosure Law” became effective on June 1, 1998 and was amended as of January 1, 2000 by Assembly Bill 248. The law requires that, before the completion of the property sale, the seller disclose any “material facts” that could possibly affect (1) the value of the property, (2) the ability to develop, or (3) the safety of the occupants.
This disclosure requirement applies to all “real property” transactions and mandates the use of the Natural Hazard Disclosure form appearing in the Documentation page on this site.
The hazards described below are required to be identified for all real property transactions in the State of California.
- A "Special Flood Hazard Zone" identified by the Federal Emergency Management Agency
- An "Area of Potential Flooding" shown on a dam failure
inundation map pursuant to Section 8589.5 of the Government Code
Wildfire Risks
- A "Very High Fire Hazard Severity Zone" pursuant to Section 51178 or 51179 of the Government Code
- A "Wildland Fire Area" pursuant to Section 4125 of the Public
Resources Code
Earth Movement
- An "Earthquake Fault Zone" pursuant to Section of 2622 of the Public Resources Code (Alquist-Priolo Special Studies Zones)
- A "Seismic Hazard Zone" pursuant to Section 2696 of the Public Resources Code (Earthquake Induced Landslides or Liquefaction areas)
